Service Areas

Binding Financial Agreements

The Family Law Act enables parties to a marriage or a de facto relationship to enter into their own agreement in respect of their financial affairs without the need to approach a Court.

Consent Orders

Where parties reach agreement in relation to property orders, maintenance and/or parenting matters, they can obtain consent orders through the Court.

De Facto

Person’s separating from a de facto relationship may apply to the Court under the Family Law Act for a property settlement.

Divorce

An application for divorce can be applied for by solely by the Husband or the Wife or if both parties consider the marriage over, they may apply jointly.

Going to Court

As a last resort, if parties cannot reach an agreement as to property, maintenance and parenting matters, they can commence proceedings.

Parenting Matters

When there is a child under the age of 18 years involved in proceedings, there is only one consideration: the best interests of the child.

Property Settlements

The Family Court of Australia and Federal Circuit Court of Australia have jurisdiction to make Orders for the alteration of property interests of the parties to a marriage or de facto relationship under the Family Law Act 1975 (Cth).

Spousal Maintenance

Spousal Maintenance is financial support paid by one spouse to the other spouse.

Legal Aid NSW provide’s legal services to socially and economically disadvantaged people all over New South Wales.
